Terms of service

These Terms and Conditions ("Terms") govern your use of milkandhoney.com ("Website") and your receipt of services at any milk + honey Spa, milk + honey medSPA, or milk + honey Salon location ("Locations"). By using our Website or visiting our Locations, you agree to these Terms. If you do not agree, please do not use our Website or services.

milk + honey, llc, d/b/a milk + honey Spa, milk + honey Salon, milk + honey medSPA, and milk + honey Products ("milk + honey," "we," or "us") reserves the right to update these Terms at any time. Changes will be posted to this page with a revised effective date.

use of website

Our Website is intended for guests who are at least 18 years of age. By using our Website, you represent that: (1) you are 18 or older, or are otherwise at least the age of majority in the jurisdiction in which you reside; and (2) fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties as described in these Terms.

You agree not to use our Website for any unlawful purpose or in any way that could damage, disable, or impair our Website or interfere with any other party's use of it. You may not attempt to gain unauthorized access to any part of our Website, or any system or network connected to it.

All content on our Website, including text, images, logos, and graphics, is the property of milk + honey, llc or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our Website without our express written permission.

reservations

Advance reservations are required for all spa, salon, and medSPA services. To hold a reservation, a valid credit card must be provided at the time of booking. This applies even if you intend to pay with a gift certificate.

Possession of a gift certificate does not guarantee appointment availability. We recommend booking in advance, particularly during high-demand periods.

cancellations + no-shows

We understand that plans change. If you need to cancel, please provide at least 24 hours notice before your scheduled reservation.

spa + salon services

If you cancel within 24 hours of your reservation, or do not arrive for your scheduled reservation, you will be charged 50% of the treatment price.

medical aesthetics treatments

If you cancel with less than 24 hours notice, or do not arrive for your scheduled reservation, a flat fee of $75.00 will be charged. This applies to all medical aesthetics services, including consultations and follow-ups.

running late

If you arrive after your scheduled start time, we will do our best to accommodate you. We may need to shorten your service to avoid affecting other guests. If you arrive late enough that we are unable to perform the service, the cancellation policy above applies. We can reschedule at no charge if you arrive late, but cannot guarantee same-day availability.

membership members

Members are subject to the same cancellation terms above. If we are unable to charge the card on file for cancellation fees, we reserve the right to apply those fees against available membership funds.

afterpay

milk + honey accepts Afterpay for eligible purchases. Afterpay allows you to split your purchase into four interest-free installments. By selecting Afterpay at checkout, you agree to Afterpay's own terms and conditions, which govern the installment arrangement between you and Afterpay. milk + honey is not a party to your agreement with Afterpay and is not responsible for any fees, interest, or issues arising from your use of Afterpay.

Afterpay is not available for all purchases. Eligibility is determined by Afterpay at the time of transaction.

gratuity

Gratuity is not included in the price of services. Gratuities at milk + honey average between 18% and 22% of the treatment price. You may add gratuity by credit card at the front desk at checkout. Gratuity decisions are always respected and entirely at your discretion.

returns + refunds

services

We want every guest to leave feeling their best. If you are not completely satisfied with a service, please contact a manager to discuss your experience at reservations@milkandhoneyspa.com.

products purchased at our locations

Unused and unopened products may be returned within 30 days of purchase for a full refund to the original payment method. The purchase must be located and confirmed in our system. If your purchase was made more than 30 days ago or the product has been opened or used, please contact us at reservations@milkandhoney.com to discuss your options.

products purchased online

Products purchased at milkandhoney.com are subject to the online returns policy posted at milkandhoney.com/pages/return-and-shipping-policy. Items may be returned within 15 days of purchase for a full refund. To initiate a return, email ordersupport@milkandhoney.com with your order number. A pre-paid return shipping label will be provided. Therabody, TheraFace, and SolaWave items are not eligible for return.

gift certificates

Gift certificate purchases are final and non-refundable, except as required by applicable law. Unused gift certificates may be returned to the original payment method provided the purchase is confirmed in our system. Partially used gift certificates cannot be refunded. If a bonus gift certificate was awarded as part of the original purchase, the bonus certificate must also be returned for a refund to be processed.

shipping

domestic orders

Standard shipping is a flat rate of $10.00 on all domestic orders under $75.00. Orders of $75.00 or more ship free. All active subscriptions qualify for complimentary domestic shipping.

Orders are shipped to the address provided at checkout. milk + honey is not responsible for shipping delays caused by the carrier, incorrect addresses provided by the guest, or circumstances outside our control.

international orders

International shipping is not currently available. We apologize for the inconvenience and will update this page when international orders resume.

intellectual property

All content on our Website and at our Locations, including the milk + honey name, logo, trademarks, service marks, text, images, and graphics, is owned by or licensed to milk + honey, llc and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, display, transmit, modify, or create derivative works from any milk + honey content without our prior written consent. Any unauthorized use may violate copyright, trademark, and other applicable laws.

disclaimers

Our Website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

milk + honey does not warrant that our Website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content on our Website.

Service results vary by individual. milk + honey makes no guarantees regarding the outcome of any spa, salon, or medical aesthetics treatment.

If you are a resident of a jurisdiction that mandates a specific release statement, the following applies. For example, as a condition of this Agreement, California residents hereby waive the applicability of California Civil Code Section 1542, which states, “A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” By agreeing to these Terms, you expressly waive this provision of the California Civil Code and any similar law, regulation, or code provision having the same intent or effect.

limitation of liability

To the fullest extent permitted by applicable law, milk + honey, llc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Website or services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or your use of our Website or services shall not exceed the amount you paid to milk + honey in the 90 days preceding the claim.

guest conduct

Guests are expected to follow all policies and guidelines provided at our Locations, including those described in the intake forms for our various services. milk + honey reserves the right to refuse service to any guest, and to terminate a guest's membership, if they engage in disrespectful, inappropriate, or disruptive behavior toward other guests, employees, or milk + honey itself.

In the event of membership termination due to a conduct issue, any remaining membership funds will be forfeited in accordance with the milk + honey Rewards Terms and Conditions.

third-party links + services

Our Website may contain links to third-party websites or services, including Afterpay, Google Pay, and Apple Pay. These are provided for your convenience only. milk + honey does not endorse and is not responsible for the content, privacy practices, or terms of any third-party website or service. Your use of any third-party service is governed by that party's own terms and conditions.

governing law

These Terms shall be governed by the laws of the State of Texas, without regard to any conflict of laws principles.

arbitration

Any dispute or claim arising out of or related to these Terms that cannot be resolved informally shall be subject to binding arbitration, under the Arbitration Rules of the American Arbitration Association. Neither you nor we will have the right to litigate that any dispute or claim arising out of or related to these Terms in court, or have a jury trial on that dispute or claim. Further, any claim must be brought on an individual basis, and neither party will have the right to participate in a representative capacity or as a member of any class pertaining to a claim subject to arbitration. Any arbitration hearing shall take place in Austin, Texas unless the parties agree to an alternate venue.

Any demand for arbitration shall be filed in writing with the other party to these Terms and with the American Arbitration Association. A demand for arbitration shall be made within a reasonable time after the claim has arisen, and in no event shall it be made after the date when institution of legal or equitable proceedings based on such claim would be barred by the applicable statute of limitations.

The arbitrator shall have the power and authority to award any relief that would have been available in court, including equitable relief (e.g., injunction, specific performance) and, cumulative with all other remedies, shall grant specific performance whenever possible. The arbitrator shall have no power or authority to alter these Terms or any of its separate provisions, including this section, nor to determine any matter or make any award except as provided in this section. Either you or we may seek equitable relief in aid of arbitration prior to arbitration on the merits to preserve the status quo pending completion of such process. This section shall be enforced by any court of competent jurisdiction, and the party seeking enforcement shall be entitled to an award of all costs, including legal fees, to be paid by the party against whom enforcement is ordered.
